  •  The Measures for the Administration of Environmental Statistics, which have been adopted at the sixth executive meeting of 2006 of the State Environmental Protection Administration on October 18, 2006, are hereby promulgated and shall come into force as of December 1, 2006.

    The Interim Measures for the Administration of Environmental Statistics promulgated by the State Environmental Protection Administration on June 15, 1995 shall be simultaneously repealed.

    Measures for the Administration of Environmental Statistics

    Chapter I General Provisions

    Article 1 For the purpose of strengthening the environment statistical administration, and guaranteeing the accuracy and timeliness of environment statistical materials, these Measures are formulated in accordance with the Statistics Law of the People’s Republic of China (hereinafter referred to as the Statistics Law) and the Detailed Rules for the Implementation of the Statistics Law.

    Article 2 The tasks of environmental statistics are to make statistical surveys and analyses of the information about the environmental situation and the environmental protection work, provide statistical information and consultation, and exert statistical supervision.

    The contents of environmental statistics shall include the environmental quality, environmental pollution, treatment and control of environmental pollution, ecological protection, nuclear and radiation safety, environmental administration and other matters relating to environmental protection.

    The types of environmental statistics can be divided into: general survey and special survey, regular survey and irregular survey. Regular surveys include statistical annals, statistical semi-annals, quarterly reports and monthly reports, etc.


    Article 3 The administrative structure under unified leadership with each level assuming responsibility for its own work shall be implemented for environment statistical work.

    The environmental protection administrative department of the State Council shall, under the operational guidance of the statistics administrative department of the State Council, conduct uniform administration of the national environment statistical work, formulate the rules, standards and work plans for environmental statistics, organize to carry out the scientific research on environmental statistics, arrange and guide the national environment statistical work, collect, administrate and promulgate national environment statistical materials.

    The local environmental protection administrative department at or above the county level shall, under the guidance of the environmental protection administrative department at the higher level and the statistics administrative department at the same level, take charge of the environment statistical work within its own jurisdiction.

    Article 4 The environmental protection administrative department at each level shall strengthen the construction of its environment statistical capacity, incorporate the construction of environment statistical information into its development plans, establish and improve the environment statistical information system, use modern information technology to furnish its own department and its subordinate statistical institutions in a planned manner, enhance the ability to handle the environment statistical information, and satisfy the requirements of its own jurisdiction to the environment statistical information.

    Chapter II Environment Statistical Organs and Personnel

    Article 7 The environmental protection administrative department of the State Council shall set up a special statistical organ to uniformly take charge of the environment statistical work. The relevant bodies (offices and bureaus) under the environmental protection administrative department of the State Council shall be responsible for the professional statistical work within their respective functions.

    The environmental protection administrative department at or above the county level shall determine the organs to assume environment statistical functions, set up posts, and designate personnel to uniformly take charge of the environment statistical work.

    Article 8 The statistical organ in the environmental protection administrative department at each level (hereinafter referred to as the environment statistical organ) shall assume the following responsibilities:

    (1) Formulating the rules and plans for environment statistical work, and organizing the implementation thereof;

    (2) Establishing and improving the system of environment statistical indices, and uniformly administering environment statistical survey projects;

    (3) Carrying out environment statistical analysis and forecast;

    (4) Carrying out environment statistical quality control and supervision, and taking measures to safeguard the accuracy and timeliness of statistical materials;

    (5) Collecting, gathering and verifying environment statistical materials, establishing an environmental statistical database and administering it, and providing environment statistical information as published to the outside;

    (6) Submitting environment statistical materials to the statistics administrative department at the same level and the environmental protection administrative department at the higher level according to the provisions;

    (7) Guiding the environmental protection administrative department at the lower level and the statistical survey objects for the environment statistical work; and organizing the environment statistical personnel for professional trainings;

    (8) Carrying out the scientific research on environmental statistics, as well as the exchanges and cooperation concerning domestic and overseas environment statistical work;

    (9) Taking charge of the confidentiality work on environmental statistics.

    Article 9 Any relevant functionary organ under the environmental protection administrative department at each level shall be responsible for the statistical work within its own functions, and assume the following responsibilities:

    (1) Formulating environment statistical survey schemes within its own functions, submitting them to the environment statistical organ at the same level for examination, and organizing the implementation thereof upon approval according to the provisions;

    (2) Collecting, gathering and examining the environment statistical data within its own functions, reporting them to the competent functionary organ under the environmental protection administrative department at the higher level as required by the survey scheme, and simultaneously sending a copy thereof to the environment statistical organ at the same level;

    (3) Carrying out the environment statistical analysis, and putting forward suggestions concerning the matters within its own functions.

    Article 10 Organs, groups, enterprises and public institutions under the scope of environmental statistics shall designate specials persons to take charge of the environment statistical work.

    Organs, groups, enterprises and public institutions under the scope of environmental statistics shall assume the following environment statistical duties:

    (1) Improving the rules for environmental computation and monitoring, establishing and improving original records, statistical ledgers and accounting rules for production activities and operation of environment protection facilities;

    (2) Submitting and providing environment statistical materials according to the provisions, and taking charge of environment statistical forms and basic environment statistical materials of their respective entities.

     

    Article 11 An environment statistical organ and its personnel shall be entitled to independently exercise the following authorities in the environment statistical work, and no entity or individual may disturb or obstruct it:

    (1)The power of statistical surveys, namely, investigating and collecting relevant materials, holding relevant survey meetings, requiring relevant entities and individuals to provide environment statistical materials, checking all the original records concerning environment statistical materials, and requiring relevant entities or individuals to correct untrue environmental statistical data, if any;

    (2)The power to make statistical reports, namely, sorting out and analyzing the materials and information obtained by way of environment statistical surveys, faithfully and timely submitting environment statistical materials to its superior organ and the statistics organ;

    (3)The power of statistical supervision, namely, supervising, according to the environment statistical surveys and analyses, the environment statistical work, pointing out any existing problems and putting forward improvement proposals.

    Article 12 The environmental statisticians in the environmental protection administrative department at each level as well as those in the enterprises and public institutions shall remain relatively stable.

    Where an environmental statistician is transferred away, the relevant entity shall timely report it to the environmental protection administrative department at the higher level and the statistics administrative organ at the same level, and do a good job in the hand-over of environment statistical materials.

     

    Chapter III Environment Statistical Survey System


    Article 13 The environmental protection administrative department at each level shall, for setting an environmental statistical survey project, formulate an environment statistical survey scheme in advance.

    An environment statistical survey scheme shall include the name of the project, survey organ, purposes of survey, survey scope, objects, methods and time for survey, main contents for survey, statistical survey forms and instructions for the objects of survey to fill out, comprehensive forms and instructions for sort-out and reporting, personnel necessary for statistical survey and sources of expenditures.

    The contents for an environment statistical survey scheme can be regularly adjusted.

    Article 14 An environment statistical survey scheme shall be implemented after being examined and approved under the prescribed
